Short summary experiences

I am a dual-qualified civil engineer and lawyer, specialising in construction law and dispute resolution across various jurisdictions. I have more than 36 years of experience in the international construction industry, spanning all stages of the construction process – from project procurement, construction supervision and contracts administration, construction management for contractors, and dispute resolution through the FIDIC Engineer, Dispute Boards and international arbitration. As the FIDIC Engineer, I determined disputes on approximately 30 projects in South and Central Asia, which were predominantly based on the FIDIC Conditions of Contract 1987 (4th edn), with a cumulative value in excess of $2 billion. Over the last 11 years, I have been involved in more than two dozen Dispute Board proceedings as counsel, advisor and consultant to both contractors and employers. The proceedings included disputes over the valuation of variations, value engineering, delay analysis, entitlement to extensions of time and prolongation costs, responsibility for the design, errors in the design, unforeseeable ground conditions, price adjustment, force majeure, termination and entitlement to payment of costs upon termination. My dispute resolution experience also includes the mediation of disputes between FIDIC Employers and international road construction contractors in Central Asia over the termination of contracts, as well as the drafting of settlement agreements for the parties. I am currently engaged as counsel in an ICC arbitration over a wrongful termination dispute in an Eastern European country (EUR 42 million). I have also acted as counsel in an ICC arbitration between an international contractor and the Ministry of Transport in a Central Asian country (USD 30 million). Similarly, I have advised an Employer in a Central Asian country in an ICC arbitration against a major European contractor (USD 138 million).
