Short summary experiences
Most of the Dispute Boards (DBs9 I have served in and still serve in were/are Standing DBs. Although the construction contracts foresee that the DBs be installed at the outset of the works, most of them were only established when the works had already substantially progressed and disputes had developped to a stage that the parties were not able to resolve them by direct negotiations. The Dispute Avoidance role of the DBs was therefore not able to be well pursued. However the Informal Opinion facility helped in a lot of cases to stop developpment into full disputes, in particular in cases of disagreements on interpretation of contract clauses. Where decisions were given in many cases Notices of Dissatisfaction were issued, mainly by employers. However, to my knowledge all disputes were later settled by the parties based on the DB decisions._x000D_FIDIC's policy of promoting Standing DBs, as in the new 2017 Editions, will surely help the application of the Dispute Avoidance function. A further step could be to make the DB agreements to be in force at Commencement Date compulsory.
