Foreword
This Supplement has been prepared for use with Conditions of Contract for Works of Civil Engineering Construction, Fourth Edition 1987, reprinted in 1992 with further amendments. The Supplement comprises three sections as follows: Section A provides for a Dispute Adjudication Board. Traditionally the FIDIC Conditions of Contract have given authority to the Engineer to give a decision in the event of a dispute arising between the Employer and the Contractor. In recent years there has been a move away from this particular role of the Engineer and various alternative methods for dispute resolution have been developed. The particular alternative which is finding increasing favour for the FIDIC type of contract for civil engineering construction is the appointment of an expert or experts at the beginning of a contract, who keep in touch with work in progress by means of visits at regular intervals and are then available to act in resolving disputes should any arise. FIDIC agrees that this is an acceptable alternative to the Engineer's former role in dispute adjudication. The wording in Section A provides for a Dispute Adjudication Board, which may comprise either one or three members, to replace the Engineer in this role. It gives amended wording for Clause 67 - Settlement of Disputes, a guide to the amended Clause 67 and Model Terms of Appointment and Procedural Rules for the Dispute Adjudication Board. This Section of the Supplement includes amendments required to the Appendix to Tender corresponding to the amended Clause 67. Section B covers payment on a lump sum basis instead of the use of a bill of quantities. Following an introductory note, this Section of the Supplement contains amendments to the clauses in Part 1 General Conditions of the FIDIC document to enable payment to be carried out on a lump sum basis. Section B also contains amended forms of Tender and Agreement corresponding to the lump sum basis. Section C provides alternative wording to safeguard the Contractor in the case that the Engineer is late in certifying interim payments.
